I'd like to take this opportunity to thank each one of you on the immigration voice core IV team for your dedication and perseverance and, congratulate all of us on this triumphant success with the USCIS decision in our favor. I very closely watched the immigration voice threads, especially, over the past week and don't think would have found a better blogspot for realtime updates and advice. Its been a tough time for most of us and that was sure evident with rising tempers on the forums and restlessness that was tangible. I think a celebration is in order. Cheers!!! ;)

first: my use of an extreme exemple to explain the EB category difference seems to have caused misunderstanding and offence amomg some people. this was not the intention, no slight was intended to anyone. sometimes one uses an extreme situation to make a point (3 yr degree in this case). I was not trying to stereotype and if that is how it came through...here is my humble apology.

i did reply to some of the posters by pm and had some intersting comments/discussion. its one of the nice things about this forum that people bring different insights into a problem...

qvadis, there is fundamental difference between allotting Employment based Gc on the basis of country of birth and based on job classifications/requirements. One happens to pertain to employment, the other is simply a way to mantain ahem "purity".
having said that, i do not favor the removal of country quotas in isolation- the redistribution of dates would make things better for long suffering people but it would not change the overall picture. therefore i support the package in its entirity (as does IV), ie recapture + STEM exemption + removal of country quotas. this would bring in substantially increased numbers and resolve the problem with ROW dates.

now that its established that this thread will not go back to its original intent, do the OPs mind if i close it? may be best to restart the discussion in a new thred?

I tend to agree with every word you said, it is not EB2 or EB3, in general it is EB community as a whole. Recapture+STEM+removal of country limit, will help us all a lot. Lets just focus on this chore. And not get swayed away with winning and complaining.

Leadership can't be demanded/begged from other people. Either you lead or if not ... then just pray that others will.

I think it can be demanded or requested. The people who have the role of the admin or have control over the forum can post such appeals on the front page. Not everybody on this forum can do that.

Hi, I'm very tensed. I applied for H-1B under master CAP. I have finished all degree requirements including depositing PhD thesis. However, at the time of filing I could not wait for a letter from the registrar (it takes 5 business days).

So, I filed with a letter from my dept. The letter has the letterhead of the university and states that I completed all degree requirements and will graduate May 13th. It is signed by the dept associate dean.

Would that suffice? Could the petition be denied?

I have seen some denials but all for ppl who hasn't actually completed all requirements at the time of filing.

The petition was filed under regular processing, VSC. I got a receipt notice dated April/24. Online status still shows case pending.

How to contribute? I have a regular payment going out to IV. How to ensure this one goes to this separate bucket and not mixed with the general contributions.

This is not a legal advice to anybody, just explaining who I did!! Risk is yours!!.

On my passport "Surname" was empty. Complete name was under "Given Name". Assuming on passport:
Given Name: ?Harjinder Singh"
Surname: ......empty....

Just went to Embassy of India - Washington DC. Filled a "Miscellaneous form" and under purpose pick OTHERS and write ?Name Split". Then write on form what you want.
I requested " Split my name as Given Name = Harjinder; Surname = Singh".
Attach a photo on form, pay 20$ fee and collect a corrected passport next day.

As long as you are not changing the name this should be fine otherwise what will be in advertisement " My name is Harjinder Singh and I want to declare my new name is Harjinder Singh???" unless changing a name it seem simple 2 day task via Miscellaneous form.

Rest EAD / 485 I don't know because I am not at that stage yet.

Hi,
this is my first post...
I've seen most of you guys are indians, I admire you for being so organized and brave, and also for getting skilled enough to be sucessfull anywhere.
I'm not in the IT business, I'm not indian, I don't have special skills nor advanced dregrees. I'm just a regular guy who has worked all his life to achieve what he got. Since my degree is a 3 years old, I did not qualify foe EB2 even being in a managerial position for over 10 years.
I was waiting for the opportunity to file my family's I485 and then my company was bought and I was laid off on jun 14th.
I've been 6 years in this country, I have 2 american born kids, I've paid a lot of taxes, I have a house mortgage, a car loan...
Now I'm out of status and worst of all, everything on the GC process is lost.

I don't think it's fair, I've never done anything illegal, but I'm not ready to leave the country. I need to sell my property, don't know what to do with the car, my wife is on her MBA thesis, I just can't leave.

I'm telling all this not because I want you to feel sorry, but to create awareness that it's NOT on your hands being legal or illegal. You're in others hands: your employer, USCIS, the adjudicator officer.

So don't judge others just because you have been lucky enough to maintain your status...

I am really sorry about your situation. While, it is true that there is a lot under USCIS' adjudicator's control, we need to give it our best try and exhaust our options before we give up. I think that being Indian, IT and skilled (I am all 3 !) does not have that much of a bearing on one's life situations and connection to green card being approved. Case in point : I went through a rough time myself (see beginning of the thread) and even paid the price (divorce, heartbroken) for taking a chance. However, everyones situation is unique.

If you can post details of your case, then someone from here is sure to be able to give you some guidance. One last piece of advice, there is no substitute for a damn good lawyer who can get you the results. It might not come cheap though. There are instances of people having accrued unlawful stays beyond 1 year and lawyers having gotten them their EB based green cards later through CP using tricks such as waivers etc.

Where there's a will, there's a way.

Isn’t it odd that the timing of your rally coincides with the introduction of the Strive act?
Granted you scored a point when you were allowed to file for employment authorization this July. If your one rally worked, do you really think other rallies will work too? The world of politics is driven by numbers; you do not have enough numbers to get any lawmaker interested. So wake up Macacas, admit it, you all are bunch of losers.

So far as the skills are concerned, you have been harping on the theme that you are highly skilled? If the definition of highly skilled is a mere undergrad degrees then 75% of Adult Americans are highly skilled. I bet not even 5% of you have PHDs and you call yourself highly skilled. Huhhh


And this for the leadership of your organization: You are wasting your time. If you are so desperate to get green cards contact me. We will see what we can do… One thing I believe though is this country needs people with leadership skills and not so called "Highly Skilled". So I will be more than happy to work with you. Hi Guys.. need someone to answer my question, if possible. Thanks in advance.

My PD is Sep 2004 ( EB2 India ) and I was also July 2007 filer, and also the victim of my 485 being closed by USCIS nebraska in May 2008, which anyways got reopened within a month after supplying necessary documentation ( Approved I140 and moved to new company etc ) . I work on an EAD now. My question is

1) My AP is expiring in mid October. Should I file for a AP renewal and spend extra money ? Do I have a chance of getting GC in September ? Btw I was told last year at USCIS newark, NJ office that all the background checks and other things show clear on my case.
2) I moved my apartment 2 blocks away early this year, but my city and zip code are the same. If I file an AR11 ( change of address ) , will it raise any flags, since I have read on this forum that a change of address sometimes prompts an RFE. I am a bit scared of going through ups and downs, so I just feel like not doing anything which might create any kind of issue after so many years of pain.

Please give your insight. Thanks so much in advance !

IV core team did an outstanding job for achieving this.
I really appreciate their efforts.
This is a big success for us. As a small token of appreciation, I am donation 100 dollars now.

Once we cross Aug 17, IV should seriously think of how to resolve the backlogs of I-485 and also should think of new people who need to file I-485.
I appreciate the goals of IV and I extent my continous support for IV in getting the goals achieved.
