My wife appeared for Visa interview on 6th and yet to receive the passport. we booked tickets for this weekend and seems we have to reschedule. I sent a mail to NIV and no response as of now.This is of concern. can anyone tell me about the normal turnaround time for H4 Visas these days?

It is very important to put proper subject in your e-mail. Please refer to the chennai consulate website for more information. Because of the volume of e-mails they'll be getting, they don't respond to normal e-mails. I got the response the next day. I don't know if i am a isolated case but it doesn't hurt to follow the instructions in the website.

Fraud and abuse is more in H1b. 20% was found by USCIS. Many fear it could be more. Mainly Indian bodyshopping and consulting companies are main reason. Another reason is many fear that H1b and L1 program is main reason outsourcing. Many big companies laid off US workers and did outsourcing to cut cost and they were asked to give Knowledge transfer to the onsite resources (those who are H1b or L1). Number of jobs in High skilled are very less (may be 2%) compared to low skilled in US. So they think 65k is more in percentage terms. US congress expects that H1b should be used only when no US Workers available. That is the reason there is no support at all at congress to increase H1b Cap. When they put a H1b restriction for TARP companies it was passed uniamously. So if we need EB reform just we need to disassociate or take neutral stand on H1b. They cannot remove H1b as it was with WTO.

My H1 which was approved back in 2006 has been re-opened today...This is the status I see on USCIS web-site
Application Type: I129, PETITION FOR A NONIMMIGRANT WORKER
Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.
We reopened this I129 PETITION FOR A NONIMMIGRANT WORKER on April 26, 2009, and are now reviewing our earlier decision. We also mailed you a notice describing the next steps in the process. Please follow any instructions on this notice. Our review should be completed within 30 days. We will notify you by mail when we make a decision or if we need something from you. guys - i want to start a new forum on 401K ..
want to discuss what happens to people who have 401k contribution and want to go back to india
do we have to withdraw the 401K when we leave or can we withdraw it at a later date..
can some one start a new thread since i cannot figure out how.. thank you
401k is YOUR money (all that is vested). You can withdraw it whenever you want. Its not like SS benefits. Having said that, you dont have to withdraw it if you dont have the immediate need. Even if you go back, just let it be there, it will be kept invested, and will hopefully continue to grow.
And when you feel the need, just withdraw all/part of it. You will have to pay the taxes that were deferred, plus a penalty of 10%. But, with the company matching and the investment growth, in all probablity, even with the penalty+taxes, you will withdraw more than you have invested. So, dont worry about 401k.

IMHO the entire IT industry is a bunch of frauds. Look at the thirsty CEOs who bankrupt companies and move on, look at the outsourcers who identify countries where labor is cheap and dump.
Sometime back, in India - IPC (Indian Penal Code) did not have any provision for cyber crime - so many people would justify - cyber crime is not wrong. Until laws came into picture - but it still goes on.
Unless system is cleansed and people are made to understand laws better and interpret them in the right way, things are not going to change at all

Now that USCIS / DOS know that they have made mistake and also aware that this is exposed to the entire country. So this is what they are doing.
1. Keep all the applications pending so that AILF could not start the lawsuit. ALIF needs rejection proof.
2. Updated their site stating the receipt notice will be sent after Aug 1st, So everyone keeps quiet till this date.
3. I beleive, the Judge will rule out by July 29 saying that itis fault of DOS / USCIS and say they have to accept all the applications which are filed in July leaving the applicants only two days to file.
4. No one can argue that all the ELIGIBLE applicants should be allowed to file. The reason is NOT all the eligible applicants filed in June. Also if you feel that you are eligible for July, then you should have prepared all your application papers ready by July 29. If you cannot file, you are out.
I feel, this is what is going to happen. So better prepare your papers and keep it ready.
As per our lawyers, right now USCIS is in the process of entering our applications in their system (for date of receipt and such). There was a memo from USCIS saying that they will be done with the job of data entry by August 1.
From August 1, we can expect either rejection or acceptance of the actual application. The hope is that a court/congressional intervention before August 1 will change the USCIS action of rejection into acceptance.
