Hope is ok. But IV core has more access than normal members like lawyers, lobbyists. So their view is important. Atleast interpretation of Memo need to known to the members. Also feasiblity of succcess, amount of effort and money need to be known to the members. I am seeing silent in most lawyer sites like immigration-law, shusterman, ILW. Everyone posted memo but no one really that much bothered

I request you not to deviate from the topic. Lets hope IV core come up and support in this.

Logiclife, I am sorry you are wrong.You don't need to post hour by hour update, but the update you posted today on Aman's meetings , help people to understand what really IV is doing and are necessary atleast once a fortnight.I am sure you are working in a corporate world and drive projects.The first rule on driving a big project is status meetings once every week.This helps all the stakeholders.

I don't know why but we tend to be satisfied with lsmall benefits...
I agree with you "something (EAD and AP) is better than nothing"
But i bet you ..you will find your self in the same situation of agony and endless waiting for the final Green card.
I bet most of the people don't use your ead and AP as it puts you in a gray "Adjustment of status". They are good to have though. But you will see...how painful it is to decide to use them or not..

What i want to say is that being able to apply for EAD and AP is not the end of the battle..you will be stuck in a depressing situation waiting for the final green card.How do i know? .. I went through it...waiting for GC for the past 4 years.

I dont know its FBI or its just the USCIS incompetence but waiting in the final stage is horrible. Every time you travel you are scared...AP as for as my lawyer goes IT does not guarantee 100% entry in to the country.

After you apply for AP its only 1 year H1 increments.

What i am saying why dont we try for the overall improvement of the GC processing. Why dont we be firm about not wasting the GC numbers and recapturing the unused numbers.

We had a small revolt (peaceful way) and its successful.We dont want to stop there.

LETS FIGHT FOR THE OVERALL IMPROVEMENT OF THE GC PROCESSING

I hope you guys are with me..looking for your comments

I submitted usps money orders for I-485 fees. Filed on july 2nd.

Any way to find out if those money orders are enchashed or no?
I did try google search and so far no answer.

i did the same, because i thought that what my lawyer wanted.
The only way to track tme money order is after 60 day from bying it. You can go to the post office and they will invistigated. it cost 5 dollars. They wont do it before 60 days. i went and asked.

Agree with macaca, It is not fair to expect a member to contribute the moment s/he joins.
Suggestion: IV membership should be free for the first 3 months, after which there should be a minimum $20/per month to keep your membership and log in.
Also at that time a member needs to update his/her profile to include contact information. This way we encourage new people to come study the issues, gain trust with IV and IV gets real people with real names that can be contacted if and when there is a need for mass-campaign.

It is very easy to prove that USCIS did injustice to those with EB3 dates prior to 2004 or 2005 if they stick to the rule of FIFO.
If the first criteria is met, everyone with a PD older than the lastest EB3 ( I know some who got approved with EB3 PD Jan2007)approved so far should also be approved. Or USCIS should go and revoke the GC's to newer PD and allocate them to older PD in the EB category ( I don't like this option).

So let us dream and someday it will come true. If we scream soon our throat will go dry.

ICICI is good at advertising false figures (with our money of course) and SBI is little delayed in updating their websites - does that solves the equation :)

SBI rate is 43.21 for $4001 but i'm sure that's not latest because the website is not updated hour by hour ( like ICICI/R2i/C2i at least do for AD) but I've seen honesty in SBI's dealings when they actually convert $ to Rs. Even if the website shows lower rates they converted my money with higher rates because the market rate was higher during conversion.

They are not gonna update the web site every day....I have asked them about it and the below are the reply from them

We in SBI declare rates as per the market conditions and every day the rates are updated on our site between 10.00am and 11.00am as per IST. excluding saturday and sunday or any bank holidays.
We are transparent about exchange rates and whatever the rates are updated on the site that rate is applicable to all the transaction of that particular date.
Exchange rate is applied when the transaction is processed(i.e 4th - 5th working day after initiation) and not the one when its initiated.The exchange rate appearing on your screen at the time of request is an indicative rate.

my I-485 was pending from 2001 and then my case was transfered to NBC I had an interview and then I got the I-797 Welcome Notice welcoming me as a permanent resident of the United States and it said on the notice you will get your green card in the mail in about 3 weeks and then checked my online status it said we ordered the card for production
ok at this point everything is looking good
and then after 5 days check my status online
found the following :

Application Type: I485 , APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS

Current Status: Case reopened or reconsidered based on USCIS determination, and the case is now pending.

We reopened this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS on November 29, 2007, and are now reviewing our earlier decision.

Just wait for 30 days from the date of card production to see if you get it in the mail....

I have a valid H1 approval till 2011 and used AP for my previous india visit. Right now i am transfering my H1 to a new company.
I asked my lawyer if i was on H1 status or not? She replied, Unitl you use EAD, i will be on H1B Status.


and also we can transfer our H1 to new company also. thats what i am doing now.

hope this helps!! and this was the answer from 2 lawyers which i asked.

Duration for I-94 while entering on AP is same as validity for AP. I am not sure what will happen in the scenario below:
A person on H1B validity for two years enters US on AP, which was valid for an year. He/She gets I-94 for only one year. in case person do not have any travel plan for next two year, will he be out of status after year as I-94 would have expird after one year and he/she kept working for H1B sponserer for two years.


Another questuon is Does renewed AP also comes with new I-94, like H1B renewals?
