- When a new employee arrives his/her knowledge of immigration matters is quite less and doesn't intend to take risks of going against the employers wishes. This is being exploited by many employers by way of threatening to cancel H1, intimidating that they will have to return back, instilling fear in all ways and means in the employees about the negative aspects. This leads the employee to think and step back in going against the employer.
Soln : Better educate the new employee about his rights as soon as he arrives. This could be either through forums, websites or even an official supplement from USCIS which should be handed over to the employee when his H1 is approved. ( It could mention and clear all myths officially by USCIS). This instills courage in the employee to question the employer if not go ahead with law suits. Also, this even may reduce threatening by the employer.
- Further most of the employees want their career slate to be clean without any law suit, dots, etc until their life is secured by way of GC approvals or some form of assurance from the Govt. This makes them step back on taking action against the employer.
Soln: Well if there could be a system where anonymous complaints/whistle blowers are allowed, they probably may come out. However, rarely employee wants to reveal his identity though he suffers.
- The immigration matters are so complicated with so many RFE's people are scared to add another their event to their history. Any transaction with USCIS is kind of a risky feel for the employee.

Lets be positive and try to accomplish something rather than just be grumpy negative people like ahem...cough!! cough!! - someone on this thread. Lets debate things openly and see how that goes. Cowards rarely win anything more than a battle or two - never the whole war.
I started visiting this forum only recently. From what I have seen briefly, I can say that the actual contributions in terms of effort seem to be coming from members like Pappu. And I really appreciate that. I see people here and there saying that IV isn't doing anything useful etc.
My point to such people would be - no one is stopping you from organizing a rally or doing a hunger strike or whatever it is you have in mind. Lead, and we shall follow. These efforts that are being led by IV core leadership doesnt detract from whatever you want to do.
Dont take this the wrong way. From what I have seen in my very brief history of following these forums, this is one of the few immigration forums out there that is not driven by ulterior motives - lawyers' interests etc. Please, please, as a favor, do not drag this effort down. I understand many of us are frustrated, but let not the frustration drag us down deeper into the hole. For people who don't agree with the policies here, put forth some constructive suggestions and see how that works. If it doesn't work, well you have realized how tough it is to get a group of people follow your conviction :) And then you might develop an appreciation for the work being done here.
And if your approach works, hey..excellent for all of us. But please don't put forth only negative criticism.

They are from the so-called conservative states.
I haven't heard anything positive for our cause from senators from the so-called sophisticated/liberal states like Illinois (Dick Durnbin & Obama) , NY , MH (Kennedy and Kerry), CA (Boxer and Fienstein) for our cause. In fact they have gone towards family immigration and are screwing us in the process.

Like any responsible corporate firm they wanted to sound a little empathetic but didn't want to give false hopes by saying a reversal was possible though they probably knew the outrage among potential filers who had been dealt a nasty blow below their belt. But VB disaster was one issue where there was not even the slightest doubt that what had happened was horribly wrong and cruel that even some cold-hearted anti-immigrants were confused for a day or two and didn't know what to say because they didn't want to pile on our heartache. The way CIS works had, like any bureacracy over time become a cold and heartless beast but since they deal mostly with non-citizens who have little rights and feel so unsecure and unwelcome in the first place to ever speak out, they were never going to know how their actions are wreaking havoc on their customers lives. So unless affected people come together and act they are never going to know how bad it sucks to be on this end of the divide. And ofcourse it's not all CIS - they are just an arm of the government carrying out the law. it's going to be next to impossible to do anything without congress stepping in. And while Fragomen is definitely not lying when they say they will work for some relief and probably are given that their partners often show up on congressional hearings, they won't lose sleep over it nor will their passion levels be anywhere near that of those who are directly at the receiving end of this current ugly messi.e iv and it's browsers. I have few other questions based on your response please. I am considering BOTH the options and will act accordingly with the BETTER option.
(1) EAD -To have the remaining of H1 as back up: If I use EAD and move to the new employer and also send AC21 documents to USCIS. My current employer will cancel H1 and revoke approved I-140. Also looking at the current scenario if USCIS denies 485 within a couple of months how do I get back to H1-B ASAP while I file MTR?
(2) H1 - Maintain H1 and use AC21 with H1 transfer(I will have around 9-10 months of H1 remaining at this point of time): And if current employer cancels H1 and revokes I-140 and that triggers 485 denial, I will still have some H1 period remaining and this should aid me in CONTINUING the new JOB while I file MTR?
