I didnot started this thread not blame anyone. Everyone knows IV is our only hope....sorry if it hurt someone.
All I wanted convey is that the current visa bulletin is an opportunity (just like jul 07), IV should try to take advantage of it. They made a mistake by putting in writing that USCIS can not estimate, lets use it to our full advantage.
Lesser mortals like myself can not do much...but surely IV core can.

Recently all of us in the IV community were thinking and worrying about what the future holds for skilled immigrants in this country. Day by day things are getting tougher! All of us in IV community (including the leadership) have different ideas about how to approach the problem. Under the IV leadership, we have a set of declared priorities and our lobbyists and community are working for those. Even when we work for those stated goals and priorities, we have to reevaluate what is feasible in the changing environment.
In this increased protectionist environment, Re-Capture, Country Cap Elimination and Immigrant Visa increase seems difficult if not impossible. So, I would like to propose a SMALL STEP, which would provide us HUGE BENEFITS and at the same time satisfy all stakeholders (including anti-immigrant community) as this is the least controversial method.
Some of us may say that this won?t work. Some of us support a big-bang theory. Some others argue for the already stated goals and priorities from the IV leadership team. I agree with all these groups of our brethren, but at the same time, I urge each and every member of our community to give a serious consideration of this proposal before shooting it down.
Please do not use this thread to point fingers at one another. Always remember, when you point fingers at someone, three of your fingers are pointing towards you and one stays neutral. Please try to avoid statements like the following in your reply to this post to encourage serious and productive discussion:

?What have you done so far for the community??
?Did you participate in these so and so initiatives of IV??
?You are a line cutter who used substitution?
Etc etc etc?the list goes on.
We have far more things that unite all of us than the few things that divide us. So, let us focus only those things that unite all of us. If we are united, we can easily solve all our differences. As AR Rahman said, always we have the option of choosing love over hate.
PROPOSAL
Our main concern with respect to GC journey is the UNCERTAINITY! I am sure all of us worried at least one time ?What happens if my 485 gets denied after all these years of waiting?? Many of us here are expecting a GC wait time of 2-12 years. So, a denial at the end would be little bit disheartening.
The normal processing time of a 485 application ranges from 4 months to 12 months. For all the retrogressed countries, this would be 2-12 years. All of us, who are in the Adjustment of Status category, are legally allowed to stay and work here in the US. So, in no way we are additional burden to the country. So, all the shackles on the GC applicant and family during the years of retrogression period are not beneficial to anyone in this country and it is not protecting anyone?s job. These shackles just inflict pain to the GC applicant and family ? that's all - nobody is benefitting from this!
So, if we can work to obtain Adjudication of all I-485s irrespective of whether the country is retrogressed or not ? we have a solution. As per the INS rules, an immigrant VISA cannot be allocated outside the numerical limit. If the country is not under retrogression, the applicant will get his GC. If the applicant?s country is a retrogressed one, instead of obtaining the Green Card, I-485 processing-status could be changed to a new one such as ?Adjudicated ? Pending Visa Allocation? (meaning: Adjudication completed, Visa allocation pending). So, in essence, when the VISA numbers are available, then only the person will get Green Card. But at the same time, the applicant and family can feel the relief ? No need to worry about RFE, NOID, MTR etc, because the 485 is already approved and it is in a Pending Visa Allocation status. So, in the case of all these retrogressed countries, the actual allocation of Green Card may take 2-12 years time depending on the availability. This option will go well with the protectionists.
If the status of the 485 application is ?Adjudicated ? Pending Visa Allocation? and the applicant?s country is a retrogressed one, S/he should be eligible to obtain 3, 4 or 5 year EADs with travel benefits associated. Also, the applicant should be able to take any job after 1 year of the status change date of the status ?Adjudicated ? Pending Visa Allocation?.
I believe the above proposal is a small step in the eyes of the protectionists where as it is a big leap for all retrogressed country applicants. We may be able to achieve this using administrative fix or an action from the Executing branch, as this won?t change the annual GC quota of 140000. Apart from this, this will encourage all those skilled immigrants to invest in American economy within 1-2 years of filing AOS application. At present most of us are sending our money to our home countries as our situation is so uncertain. This effort will definitely help the ailing economy and will serve as a boost to the housing market.
Whom should we approach to get this done?
Ans: Hillary ? Yes Hillary Clinton. She is the number 1 friend of people from China and India, who is in the current administration. Her department is also in charge of the 140K Visa numbers, Travel related visas etc. If we can get support from Compete America, prominent members of Indian and Chinese communities in US, Ambassadors of China and India to US and approach Hillary, we will be successful. Hillary may be very much pleased to start an initiative to achieve this, as she has a chance to influence 700K+ Indians and Chinese immigrants in US, in a very positive way. At the same time, politically this won?t create much problem ? Status quo will remain the same ? even after such an administrative fix. There is no net addition of immigrants to this country.
With Hillary?s support, if we approach Janet Napolitano, we may have a solution.

that's right the actual law had two words that could change the actual meaning of how they are supposed to do it (ie., vertical versus horizontal). Some people (i was one of them) thought that at such a stalemate in the words that coomon sense should prevail. Common sense would dictate that skill would prevail over diversity.
However; the rules were always such that there was never any horizontal spillover but rather vertical. The main thing that changed was that the unused visas from row could be used by retrogressed countries quarterly rather then annually.
That is why USCIS never published the regulations for AC21...They are sure as hell that their ass is gonna get sued...whatever regulations they propose... Now it is a miracle that no one has sued them....May be they are waiting for someone to sue them....

Just spoke to an IO from TSC, she said its the Filing date ( receiving date ) is what the processing time is based on
If it is true, they have revised the process, and that is good. Hoever, it also depends on how the question was posed. If you asked whether processing is based on RD or ND, they will defnitely tell it is RD. One need to ask, which of two dates will determine case processing status, if your stamped RD is 3 months earlier than the receive date you see online. Note that the site tells you to contact them if your "receipt notice date" is prior to the published date, and you are still waiting. What is "receipt notice date"?

I guess My interview didn't go as expected.
1) I reached the office an hour early.
2) After waiting,they did security check and let us in
3) Then the lady who was assigned my case, came and took us into her room
4) Oath, etc
5) She then started asking for Birth cert, Marriage Cert, kids birth certi, 140 approval copy.
6) Then she pulled a file (which was labelled DOS Visa bulletins) and spent around 15 mins on Oct 2007 bulletin.
7) Then asked us who filed your 485..you did your self or your employer did..we said employer.
8) Then she said, something is not right..per Oct 2007 bulleting Visa's are unavailable so yours was not filed properly.
9) Then I said, ours was filed in Aug 8th 2007. She insisted the receipt date is oct 2007..then we showed her our 485 reciept.
10) Then she thanked us and started looking at Aug 2007 visa bulletin. and said, even then in Aug 2007 EB2 was U, so yours was not properly filed.
11) I told her, There was an interim Memo released by USCIS that they will accept application until Aug-17 2007 based on July 2007 visa bulletin
12) She said she will look at DOS bulletins
13) After 10 mins she said, she cant find any such memo..and said, since there is no evidence with her, she has to deny our case based on "Improper filing when PD was not current"
14) Then I said, if PD was not current, wouldn't TSC return the application denying on the spot? Why would they accept the application?
15) She said, you would think so..but they accept many times..so we are told to verify all the time
16) THen said, she believes us but for process, she needs evidence and said she will look into further and then make a judgment.
17) We had no choice and we were over the interview. we were little disappointed though
18) After coming home, I realized she took all I-94s and we got panicked..because if 485 is getting denied and I-94s are gone, how do we prove our legal status, so we thought of going back..then I thought, if have to go anyway, then I should take a print out of Interim Memo
19) I went back an hour later with the print out
20) I told security that, we had finished our interview and officer forgot to return our I-94..they insisted that we shud take infopass and they wont allow anyone to go back..I had to really argue with them (I decided I have nothing to loose..anyway 485 is screwed and so stood there asking them to let me in)
21) After consistent nagging, the security guy took our passports, interview response letter(After interview if your app doesn't get appproved they willgive a kind of reciept saying u attended the interview..blahblah) and went in
22) Came back and told me to go in since the officer wants more details from you (I thought this was a miracle)
23) I went inside, and after a while officer came back. We apologized and told her that we came back for I-94s..she said they will retain and wont return..We told her that we are not using EAD and we are still on H1B..she said she will give back..
then she asked, I am sure you didnt come back for I-94 alone, did you get any document?
24) We showed her the memo.
25) She read that and said I am glad you came back..this clears everything out..I will run this by my supervisor and will see if we can adjust status today

This interview EXPOSED how un-informed and careless and whimsical are IOs in handling cases. MEMO should have been framed on their desks/mind....we don't have to remind these guys. In one moment they can deny as important a petition as AOS and just in a flash second they can approve it. They won't make any effort to dig out relevant info. It is like fliping a coin...plain luck when it comes to GC.

Is IV only for those who have filed I485?
I gave my opinion and people gave me lot of reds. There is a majority here who already have EAD and have filed I485. You people do not care for those who are less fortunate and struggling in the early stages of the process. If July 07 had not happened, all of you would be asking for I485 filing option today.
By giving reds to people who disagree you will drive people away and make IV only for those who have filed I485 and not for the entire EB immigration people.

Even during the recess, we were talking to the staff of a ton of senators. Most of the time the senators' staff are interested only if someone from 'their constituency' is also affected. We always say we have a ton of folks from each state, but nothing works like a real example.
For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.

For example, when we speak to say Senator Kennedy, it helps us to present the story of folks affected by retrogression and living in say Boston, MA. That way, the staff has some incentive to look into this and get hooked immediately.

but the categories and priorities were created to be based on the jobs too. and there are people in EB3 with bachelors degrees only. so what? it's meant for jobs that need a bachelors degree. it is indeed your misfortune to be in EB3.
It's very interesting to see the fight between EB2 and EB3. You don't seem to be concerned too much that EB3 is in a disadvantage. My wife has the same problem and problem became apparent when she was in India in March to get H1 Visa stam. 3 years back when she got her first visa stamp, we had used Last name first name format in the application form. However this time the Embassy did not accept it, in the visa issued they stamped FNU (Family name Unknown) in the section marked Given name !!! and mentioned her Firstname, lastname in section marked Surname (Exact opposite to what is in her passport !!!!). When my wife pointed this out to embassy officials, they said it is the SOP in this situation and adviced her to correct the Passport.
As I understand, correcting the name in Passport should'nt take much time. Is'nt it same day service?

I never claimed any amount for this holiday gift on this thread yet but what if I want to donate $31 or per say $ 81 one time, I do not have that option now and so I will end up not donating now and wait and donate when I feel comfortable with $ 100/- or its multiplications. That is called turning away and if you guys do not see any danger into it I do not have any further words.
Fund raising is an art and I believe our current startegy is lacking that art. If you guys see the base of any major successful fund raising (Grass root level not Political ones, mind well we claim ourselves grass root level organization)you will always find donors with $ 1 to donors with $1 million donatiing as per their will. Grass root level fund raisings can not afford constraints which normally goes successful in political and/or industrial fund raisings.
Some of the strong supporters of current policy, in their argument, automatically assume that willing donor always used to spend $ 100/- frequently for drinks or food and may be living lavish life style. But they are partly wrong in their assumption...I myself never eat outside frequently. Even on a travel trip I cook my food by myself and I normally do not drink sodas or alcohol so what abhijitp has given a example at least does not remain valid for me but I can not say that it is completely out of proportion, as it has some valid logic but it can not be true for everyone.
Point is if we make a wrong based fund raising policy, we may hurt ourselves only. I know my option, if I want to donate odd figure now, I will not be able to donate it now, and I will have to wait till I feel comfortable donating $ 100/- and/or single digit multiplications of $ 100/- but would that be considered a good and wise option?
For an example, I am emotionally charged today and I want to donate $ 61/-(As I may plan that much only..for whatever reasons) but I am not able to donate so I will not donate and say after 4 months I will be able to plan $ 100/- but what if at that time I may not be emotionally charged to donate all together? But with current policy we are completely turning away the people who may otherwise donate, for an example $ 20/- monthly-recurring policy may turn 40 new commited donors in whereas $50/- recurring option is creating only 10 donors and thus we may be ending up $ 300/- confirmed donation loss per month. This is just an example and based on assumption that less amount would attract more commited donors.
Having said all this, if majority memebrs and core still feel that this will be the only future standard for accepting donations then as I mentioned above, I will have only one option left and that is to wait till I become comfortable for donating $ 100/- ( I will remain emotionally charged...:))

I have a nine month old and I can understand your feelings. I hired a nanny through sulekha but did a lot of reference checking and tried her when my parents were around here in US and they monitored her carefully and then gave us the green signal to keep her before they left.
So not all nannies are like that. There are good nannies too. I pay a lot of money a lot more compared to what thunderbolt quoted ONLY because we found her to be nice and caring. She gets calls from her earlier employers who say their kids want to speak with nanny and say hello.
It is just your bad luck. Nannycams are very useful and plan to get one for myself just for my satisfaction even though we are happy with our nanny.
Like someone suggested - daycare would be a good option and I even thought about it but a 8 month old kid may catch alleriges easily and thats why I backed off too.
Now about legal recourse - the best thing is to get out of any kind of mess. You were aware that you must not hire a nanny illegally and now you pay the price. No problem. Just say good bye to her and be careful next time

You may have the right intentions and your heart might be in the right place. I am at a loss to understand the philosophy of your approach. I get it that in numerous previous 'campaigns' people committed to funds/help but failed to come through with action.
But I question your approach and the need for such scathing attacks. Please do some research and see if historically, 'tough love' or hurling insults has motivated people. The answer is a big fat NO.
A leader has to influence people to go from motivation which lies just below the threshold to a desire to cross the threshold to action.
Why do people decide on acertain course of action and how this turns into committment? It is known as Volition.

What exactly is meant by checking the receipt date online and it is 3 months after the date in the paper? All I see on my 485 is a statement that they have received my response to the RFE...I don't see any receipt date or notice dates on the case status online at USCIS.gov
Just wondering what you mean or am I missing something?

From the following information:
1.Grant GC to all EB 2 / 3 class pimary applicants who have completed 8 years of continuous stay in the USA without any criminal record.
Personally, I do think the above bill you requested in the #1) is extremely difficult to work. It is because there was a bill proposed to the EB-2/EB-3 applicants to occupy the annual DV-lottery of 55,000 quota but it is NOT becomed a law yet. Now is April, 2011 and the DV-lottery results of this year will be announced soon online and the coming year of DV-lottery will be drawn again later during this coming Oct, 2011 but there is still NO hope to give those EB-2/EB-3 applicants into this DV-lottery quota. If this quota is occupied by EB-2/EB-3 applicants, less applicants will be in GC line.
Also, there is a proposed bill to allow foreign US accreditated universities' advanced graduates of STEM and with a US job offer to have GC but again it is NOT becomed a law yet. Also, your proposed EB-2/EB-3 applicants who have continuous stay of 8 years in US without criminal record to have GC may not fit the requirement of US needed because some of these EB-2/EB-3 applicants are NOT graduated in US universities and some of them are NOT in Science, Medicine, Engineering and Techology academic major which US society in demand.
Last time I have read some other online news or forum, it talks about there is guy who was graduated in a US university with double Master degree---one is M.Sc in computer science and the other is MBA and he still get stuck in getting his first new H-1B visa and later he decided to back home without choice. Yesterday I have read some other online news or forum, it talks about some people who graduated in US Ph.D or doctorate degree in Science/Engineering/Medicine cannot get the GC or some of them get stuck in his or her first new H-1B visa application (due to quota was full or from other reasons) or get stuck in the H-1B visa renewed. So without H-1B visa, how can they get into the EB line for GC?----They are all US graduates and have stayed in US for more than 6-8 years to study with social security card and drivers' licenses and without criminal record !!!!!!!!!!!!!

The DV-lottery can open to any US STEM graduates to enrol online by " first come, first get" basis and if once annual immigration quota of 55,000 is filled, those graduates need to wait for another year to enrol online for immigration. So every STEM or non-STEM graduates bring money to start companies in US creating job opportunities, paying taxes and bring inflow of money----better economy is growing up.
Moreover, those graduates will invite friends/relatives to visit US, increasing sales of both international and dosmetic airline tickets, hotel reservations, restaurant reservations and uplift the profits all kinds of retail businesses. Tourist visa fees will also add monetary income. Overall, inflow of money and jobs creation are dual powers to uplift the economy.
With inflow of money from immigration, there is NO government shutdown and there is NO hiking taxes needed for the existing US companies.
Also, in Australia, it allows foreign graduates who have stayed in Australia for over 5 years and without criminal record to get the GC automatically
